To stop or avoid foreclosure in nearly any city in the United States of America, there are basically only a few legitimate options. This may seem obvious to some, but new for others who have not been able to take an objective look at their situation.

Here are a few options:

Sell your house prior to the foreclosure auction. Your local real estate market will determine if this is more easily said than done. We’ve been hearing bad news about the national real estate market for a couple of years now. Selling your home could be a challenge. The best thing to do is contact a local real estate broker who specializes in pre-foreclosure or distressed sales. He will be able to help set the price to help you sell your house in your market.

Contact your bank to negotiate a loan modification. In a loan modification your lender changes the payment terms of your mortgage to more closely match your ability to pay. There is no guarantee a bank will agree to it, but contrary to public opinion, banks don’t want to own your home. It actually costs them money to maintain it before they can resell it. Beware, though. Load modification scams are rampant, preying on desperate homeowners.

Refinance. Rates are at historic lows. If you can show income, even reduced from when you got your mortgage, you may be able to refinance to take advantage of lower interest rates, or different terms that would enable you to keep your loan current. If your property is worth less than the balance of the mortgage, you may consider a “short refinance”, which is when a lender forgives a portion of the debt to help you qualify for a loan that you will be able to pay. Beware though, of the tax ramifications. The amount of the debt “forgiven” is considered income by the IRS. It will change your tax returns.

When you’re trying to avoid foreclosure, the key is fast action.

While fast action is critical, you should also be wary of scams. There are many legitimate real estate investors and investment groups who offer cash for your home for the purpose of making money on its eventual sale. However, there has been a significant amount of fraud with “Stop Foreclosure” scams. Remember the rule of thumb: If it sounds too good to be true, it probably is.

There is a lot of emotion involved in a financial crisis, especially one that involves possible foreclosure. Sometimes the best course of action will be to figure out how to stay in your house. Other times, getting out from under the overbearing payments and starting over is best.

Getting the advice of an attorney or real estate professional or accountant (or all three!) who is not as emotionally connected to your house as you are is one good step to take. If you work with a real estate broker who has helped people in similar situations to yours (it is more common than you think), they will be able to refer similarly experienced attorneys.

Good luck.

Getting the right help on bankruptcy can appear to be a frightening task to some. One must avoid bankruptcy help that is confusing on precisely the way the process of bankruptcy works. Entrepreneurs should also be conscious of what the implications will be if such a call is made.

Many small to medium businesses have seen a dramatic slow down as consumers are buying less or not buying anything at all. These same worried firms are also having issues getting credit from banks and financing firms as the decelerating economy has put a clamp on lending.

These contributors are causing many home entrepreneurs to file for bankruptcy. It’s vital to remember that entrepreneurs should not avoid bankruptcy help. It can imply the difference between saving your business and your life and losing everything.

A Major Decision

As with any major life call, the choice to file bankruptcy should be one that is well researched. Ensure that you’ve got the right tools you want to make the best call for your present position. Avoid bankruptcy help that doesn’t explain to you that the first question you will need to ask is should you file for Chapter 7 Bankruptcy or Chapter 13 bankruptcy.

Never avoid bankruptcy help that includes all the available options that you may consider as there are many alternatives to filing for bankruptcy. Depending on the dimensions of your debt, options such as debt consolidation or credit support could be reasonable alternatives to filing for bankruptcy. Elude becoming broke help that offers to consolidate your debt at a foolish rate which will have you paying for the rest of your life.

It’s important to totally research all the alternatives before determining that filing for bankruptcy is, indeed, the most suitable option for you.

Look At The Situation

You may wish to avoid bankruptcy help till you have sat down and listed the following : the whole amount of all your liabilities including the interest rate you currently pay on each of your loans. Review your home budget with the plan of liberating additional money for debt repayment.Review copies of your present credit reports to discover what hurt your dues have recently caused to your finance reputation. Think about the potential flaws of filing, including the difficulty of getting reasonable credit in the future.

Bankruptcy should only be considered if: You cannot meet debt obligations based on your current income. Attempts to organize a payment schedule with your banks have failed. Your proportion of debt to yearly earnings is 40% or more. Prior tries to reduce debt have failed, especially with the aid of a credit advisor or debt reduction plan.

Bankruptcy isn’t a cosy out. It is unimaginable for something to be that easy for the realism that the government is essentially giving the individual permission to not pay their debts. And one knows that is something that doesn’t make one pay in any way.

Important Bankruptcy Information

When one has to file bankruptcy, one has to go into a credit support plan. The individual has to complete that credit support program ahead one ever file bankruptcy. The rationale being because one must be regarded as not ready to pay their bills. The credit advocate has to say that there is no hope for the individual to pay the debt, so bankruptcy is the only choice. When one files bankruptcy, it will stay on the credit written report for 10 years. This implies that one might have difficulty getting credit. Nearly all the folks that have filed bankruptcy are told that they won’t receive new credit for just about two years. Some are not even that lucky. Having a bankruptcy on the credit report could keep the individual from acquiring a job. The majority of the bosses are now considering credit reports to find out how an individual deals with their finances. They like to see this especially if you’re going to be dealing cash.

If you do obtain credit after filing bankruptcy, you’re looking at high fees and high interest rates. This can cost thousands more than if you had good credit. Many people try to hang fire till after their bankruptcy is removed from their credit history. After the bankruptcy is moved out from the credit history, it may still be rather tough to build new credit. The explanation being as the record is passed over clean and one has to start over again.

The good thing is to try speaking to a credit advising company and see what they can do for the individual. Credit analysis recommends can usually work out a deal with the people that involve decreasing the payment and even obstructing interest assembly. This admits one to pay the guilt off quicker. If the credit isn’t bad yet, then one can look into responsibility consolidation. This admits one to combine all the unguaranteed liabilities. If you are uncertain what unbarred debts are, they’re the liabilities that are not warranted by some variety of confirmative. Debt integration admits one to mix everything into one debt so that one has single payment that costs less than what the payments did when they were fall apart.

Filing for personal bankruptcy can be a life changing experience. Anyone having to consider filing personal bankruptcy can be terrified of all the paperwork involved and then thinking about how this is going to impact your credit afterwards can just be very overwhelming and frightening for some. Choosing the right Washington DC bankruptcy lawyer is crucial for your piece of mind and sanity as you try to navigate your way back onto the right path to financial stability.

Bankruptcy is a personal decision. Most individuals file bankruptcy because of crushing debts, often caused by financial hardships such as unemployment, lack of adequate insurance, catastrophic medical expenses, marital problems, overextended credit or, in some cases, out of control spending.

Because of the complexity of filing for personal bankruptcy, you should contact a Washington DC bankruptcy lawyer who specializes in the field. They can help you with the whole process. A Washington DC bankruptcy attorney usually charges a flat fee, which may well be worth it if you can eliminate some or all of your debt.

There are two kinds of personal bankruptcy: Chapter 7 and Chapter 13. Chapter 7 personal bankruptcy involves liquidating your assets and turning them over to the courts. A trustee of the courts follows a court-supervised operation, reduces your assets to cash, and then pays the creditors. A Chapter 13 bankruptcy is filed by a debtor who has a valuable asset, such as a house, that he or she wishes to keep, but is not covered by the state or federal exemptions. Under this kind of bankruptcy, the debtor, through the courts, sets up a plan of payment with the creditors over a period of several years.

As soon as your Washington DC bankruptcy attorney has filed your personal bankruptcy case and the court has approved the petition, all transactions are frozen. Notices are mailed to creditors who must stop all actions against you to recover or collect money. Once the debt has been satisfactorily settled under the agreement stated in the personal bankruptcy proceedings, a discharge is issued, releasing the debt. All creditors get a permanent order to stop all forms of collection action against you on discharged debts, including legal action and all communications.

In 2005, after deep concerns by Congress and the nation’s creditors, sweeping changes to the US Bankruptcy Code were signed into law. After 25 years of little modification, many felt that the laws in effect were being abused by consumers and businesses and that bankruptcy was much too easy a way to get rid of debt. Plus, proponents of the changes felt that the old laws allowed for easy abuse and even encouraged bankruptcy filings. Therefore, with the urging of creditors, new reforms were written and passed that made filing for bankruptcy much harder, exempted some debts from being discharged by bankruptcy and required that filers be educated on credit management, among other changes. The changes affected attorneys as well, increasing the amount of time attorneys had to put into preparing bankruptcy petitions and thereby raising the cost to the already cash strapped consumer.

Prior to considering a bankruptcy in Washington DC, acquaint yourself with the new requirements:

Mandatory credit counseling – As part of the reforms, bankruptcy applicants, before filing for bankruptcy, need to undergo mandatory credit counseling with a government approved counseling service. A list of approved services can be acquired from the US Trustee Program or from any Washington DC bankruptcy lawyer’s office.

The “Means Test” – Bankruptcy applicants, who want to file for Chapter 7, or absolute bankruptcy, have to pass a “means test” first. If the applicant’s net yearly income falls below the median income for their state, then they are eligible to file for Chapter 7 relief. However, if their monthly income is above the state median and they are able to pay $100 per month to their debtors, then they are entitled to file Chapter 13, or the “wage earner’s plan”, in which some or all of their debts are to be repaid to their creditors over time. This ability to pay $100 per month is calculated based on a formula that includes monthly income, monthly expenses and amount of debt.

Proof of income and tax returns necessary – Under the new laws, bankruptcy filers must now provide proof of income by providing their tax return for the past year. If the filers have unpaid taxes, they must first pay these taxes before they can file for bankruptcy.

Mandatory financial management education – After a bankruptcy has been approved, but before any debt can be discharged, the filer must complete training in financial management education from a government- approved financial management educator or program. A list of these programs is obtainable from the US Trustee Program.

Greater priority for child support and alimony – Bankruptcy filings order a filer’s creditors in particular order to receive any funds collected. Under the new laws, people who are owed child support or alimony receive higher priority on that list.

Tougher on the attorneys – and more expensive – Part of the new reforms require bankruptcy in Washington DC attorneys to personally vouch for the validity of all information submitted for their clients. This requires the attorneys to spend more time and effort on each case and consequently, makes the fees for such services higher. Unfortunately, this also makes it harder to find an attorney willing to handle bankruptcies.

Less “automatic stays” – Historically, filing bankruptcy gave the filer certain quick protections from creditors and others such as debt collections and lawsuits. Termed “stays” in legal terms, these advantages have been modified under the new laws. Immediate protection from evictions, driver’s license revocations, legal measures for child support and divorce no longer apply.

Greenbelt isn’t the most affluent community on the map, so recovering from a bankruptcy isn’t quite as easy as where there is a lot more economic development. If you’re in or around the Greenbelt area and bankruptcy seems to be in your future because you cannot seem to make ends meet, it would highly advisable to enlist the help of a good bankruptcy lawyer from Greenbelt.

A reputable Greenbelt bankruptcy attorney will be able to do a lot more for you than just deftly guide you through the somewhat challenging filing process. Your bankruptcy attorney from Greenbelt will be able to help arm you with the information that you need to get your finances in order once your debt has been absolved, and the information to hopefully help you from ever having to file for personal bankruptcy again.

In order to keep your finances straight after your debt has been cleared up, you’ll need to have a sound and sensible budget in place and you’ll have to know how to stick to it when times seem tough – this is another area where dealing with a competent lawyer can greatly increase your chances for long term success after your personal bankruptcy. As a part of the new bankruptcy laws presented a few years ago, all people filing for personal bankruptcy were required to attend a mandatory credit counseling before their debt would officially be discharged – your bankruptcy attorney can help you choose which of the government approved programs would benefit a person in your situation the most. The education that you get during your credit counseling could be the difference between the success and failure in your future financial endeavors.

A good bankruptcy lawyer will also be willing to sit down with you and answer any questions that may arise as a result of your bankruptcy. You can be assured that the answers that you get to your questions are coming from a great source because of the education and experience that your attorney has and because there probably isn’t a situation or scenario out there that they haven’t been witness to and helped resolve during their careers.

You’ll get much more out of a good bankruptcy lawyer than someone who just pushes the paper to get your debt resolved. You will get one of the world’s best resources on financial matters that are strikingly similar to the situation that you are in; you’ll get top quality information and guidance that will most likely get you out of debt as quickly as possible while giving you the necessary information to stay there.
